2012 Municipal Election

Results

The polls closed at 7 p.m. on Tuesday, April 3, for the 2012 Regular Municipal Election. Following are official election results certified by the Canvass Board on April 6, 2012.

Total number of ballots counted was 1,173, and the percent of eligible voter participation was 29.47%.

  • Joseph R. Poche - 161 votes, 14.15%
  • Russell O. Stewart - 437 votes, 38.40%

  • Alex Brown - 772 votes

Council Member for District 5      

  • Klasina VanderWerf - 761 votes

Issue #1 Passed with 1,020 Votes, 93.66%

SHALL SECTION 3.9 OF THE CHERRY HILLS VILLAGE HOME RULE CHARTER BE AMENDED BY THE ADDITION OF THE FOLLOWING SENTENCE?

"ALL PARKS OWNED OR HEREAFTER ACQUIRED BY THE CITY SHALL BE HELD,  PROTECTED, AND MAINTAINED IN PUBLIC TRUST FOR THE USE, BENEFIT, AND  ENJOYMENT OF THE PUBLIC, AND SHALL NOT BE PLEDGED OR CONVEYED WITHOUT A  MAJORITY VOTE OF REGISTERED ELECTORS VOTING ON THE QUESTION.”

Issue #2 Passed with 653 Votes, 63.34%

SHALL SECTION 4.5 SUBSECTION E OF THE CHERRY HILLS VILLAGE HOME RULE  CHARTER BE AMENDED TO READ AS FOLLOWS AND SUBSECTION F BE ADDED AS  FOLLOWS?

"(E)      AN ORDINANCE WHEN FINALLY PASSED SHALL TAKE EFFECT AND BE ENFORCED 10 DAYS AFTER PUBLICATION.

(F)       AN ORDINANCE NECESSARY FOR THE IMMEDIATE PRESERVATION OF  THE PUBLIC PEACE, HEALTH OR SAFETY MAY BE INTRODUCED AND PASSED AT ANY  REGULAR OR SPECIAL MEETING, SHALL REQUIRE ONLY 1 READING AND SHALL NOT  REQUIRE A PUBLIC HEARING OR PUBLICATION BEFORE FINAL PASSAGE.  PUBLICATION SHALL BE AS SOON AS REASONABLY POSSIBLE AFTER FINAL PASSAGE.  SUCH ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY UPON PASSAGE. A  RECITATION IN ANY SUCH ORDINANCE THAT THE COUNCIL DEEMS THE PASSAGE OF  SAID ORDINANCE TO BE FOR THE IMMEDIATE PRESERVATION OF PUBLIC PEACE,  HEALTH OR SAFETY SHALL BE CONCLUSIVE. An emergency ordinance shall not  be in effect longer than ninety (90) days after adoption unless the  Council shall affirm the same by re-adoption of said ordinance on second  reading and publication on a non-emergency basis in the manner  prescribed in Section 4.5(C) through (e) within said ninety (90) day  period. Upon such affirmation, the ordinance shall become a regular  ordinance.”

SHALL SECTION 2.3 OF THE CHERRY HILLS VILLAGE HOME RULE CHARTER BE  REPEALED AND REPLACED WITH THE FOLLOWING SENTENCE?  "A REGULAR CITY  ELECTION SHALL BE HELD ON THE TUESDAY FOLLOWING THE FIRST MONDAY IN  NOVEMBER COMMENCING IN THE YEAR 2014 AND IN EACH EVEN NUMBERED YEAR  THEREAFTER”; AND FURTHER  

SHALL SECTION 2.7 OF THE CHERRY HILLS VILLAGE HOME RULE CHARTER BE  AMENDED WITH THE ADDITION OF THE FOLLOWING SENTENCE? "ELECTED CITY  COUNCIL MEMBERS AND THE MAYOR-ELECT SHALL ASSUME THE DUTIES OF OFFICE AT  THE FIRST COUNCIL MEETING IN THE MONTH OF JANUARY FOLLOWING EACH  REGULAR CITY ELECTION.”
